CNN, MS NOW and Politico's court-ordered White House access expires Oct 8. Will Judge Timothy Kelly grant a preliminary injunction by then?

U.S. District Judge Timothy Kelly had not ruled on a preliminary injunction by October 8, the deadline tied to the expiration of CNN, MS NOW and Politico's court-ordered White House access. At a hearing that Thursday, Kelly instead extended the outlets' temporary access for two additional business days and said he would issue his decision on the preliminary injunction request by the following Tuesday. The case stems from a lawsuit the three outlets filed September 21 after Trump revoked their White House press credentials, citing what he called negative coverage.
Kelly had already granted a 14-day temporary restraining order in late September, finding the outlets were likely to succeed in showing their credentials were revoked without "constitutionally adequate due process." The Trump administration argued the outlets' reporting posed national security risks and that their journalism failed to meet professional standards, a position the Justice Department reiterated ahead of the October 8 hearing.
Most forecasters expected a ruling in the outlets' favor by the deadline, with 82% predicting "yes." Because Kelly extended the temporary arrangement rather than ruling on the injunction itself, the question resolved "no," leaving the community's strong majority prediction wrong, at least on timing.
