The Senate fell short of the 60 votes needed to advance the Digital Asset Market Clarity Act on Sept. 15, 2026, with a cloture motion failing 49-50, according to CNBC. The bill, known as the CLARITY Act, would have established a federal framework for regulating digital assets, but Republican leaders could not secure enough Democratic support to overcome the filibuster threshold despite holding 53 Senate seats.

Republican sponsors had released a revised version of the bill days earlier, adding ethics restrictions aimed at addressing Democratic concerns about public officials profiting from crypto investments. Those changes were not enough to win over holdout Democrats, and at least seven members of the Democratic or independent caucus would have needed to cross over for the measure to proceed. The failed vote delays, but does not end, congressional efforts to pass comprehensive crypto market-structure legislation this year.

The Predict Six community correctly forecast the outcome, with just 19% predicting the bill would clear 60 votes. Forbes described the cloture failure as unsurprising given the unresolved partisan disputes over the bill's provisions heading into the vote.
