A group of Vietnam War veterans and an architectural historian, represented by the nonprofit Public Citizen, sued to block construction of President Trump's planned 250-foot arch near Arlington National Cemetery, which Trump said would double as a "military complex" housing drones, snipers and ammunition. U.S. District Judge Tanya Chutkan declined to issue a preliminary injunction halting the project outright. Instead, after the administration said it planned to dig archaeological test pits rather than begin full construction, she ordered officials to give 48 hours' notice before any activity on the Memorial Circle site.

When the Justice Department later asked Chutkan to dissolve that notice requirement, arguing it had interfered with routine park operations, she refused, saying there was "little doubt" about what her order meant. But that order stopped short of a block on the arch itself, and no court issued a ruling halting the project by Oct. 2. The underlying lawsuit over whether Trump has authority to build the arch without congressional approval remains pending.
